BURŪV Terms of Service
Effective Date: April 15, 2026
These Terms of Service ("Terms") govern your use of the BURŪV smart band, the BURŪV mobile application ("App"), and related websites (collectively, the "Services"), operated by Eclipse RX, LLC ("we," "us," or "our"). By purchasing, accessing, or using our Services, you agree to these Terms. If you do not agree, do not use our Services.
1. Eligibility
You must be at least 18 years of age to purchase or use our Services. By using the Services, you represent that you meet this requirement.
2. Product Description and Medical Disclaimer
BURŪV is a smart band accessory for Apple Watch that measures ultraviolet radiation using its patented TruSun® technology, an algorithm that converts raw UV sensor data into personalized exposure metrics called Ray-Ons. The device provides UV exposure data and personalized sun safety notifications through the companion App. BURŪV is a consumer wellness product designed to support sun protection habits. It is not a medical device, is not regulated as a medical device, and is not subject to HIPAA or similar healthcare data regulations. The data it provides is not intended to diagnose, treat, cure, or prevent any disease or medical condition. BURŪV data should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider regarding sun exposure, skin health, or any medical concern.
3. Account Registration
You may need to create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and current information and to notify us promptly of any unauthorized access.
4. Purchases and Payment
All purchases are processed by Shopify Payments. Prices are listed in U.S. dollars and are subject to change without notice. Applicable taxes and shipping charges are calculated at checkout. By placing an order, you authorize us to charge your selected payment method for the total amount.
5. Intellectual Property
All content, software, trademarks, and technology associated with BURŪV, including the TruSun® technology, the Skintelligence™ platform, and all related marks, are the property of Eclipse RX, LLC or its licensors. You may not copy, modify, distribute, or reverse engineer any part of our Services or technology without our prior written consent.
6. Data Ownership and License
You retain ownership of the personal information you provide to us, subject to the rights granted in these Terms and our Privacy Policy. By using the Services, you grant Eclipse RX, LLC a worldwide, royalty-free, non-exclusive license to use, aggregate, de-identify, and analyze data generated through your use of the BURŪV product and App, including UV exposure measurements, sun protection behavior data, SPF application logs, notification response data, and general location information (collectively, "Usage Data").
Eclipse RX, LLC owns all rights in aggregated and de-identified datasets derived from Usage Data across its user base. These datasets, which cannot reasonably be used to identify any individual user, may be used by Eclipse RX, LLC for product improvement, research, and commercial purposes, including licensing to third-party business partners such as sun protection, skincare, and health and wellness companies. This data licensing is a core part of our business and supports continued product development.
For clarity, your personal information (name, email, account details) is never included in aggregated datasets shared with business partners. Only de-identified behavioral and environmental data is included.
7. Acceptable Use
You agree not to use the Services for any unlawful purpose, attempt to reverse engineer, disassemble, or decompile the hardware or software, interfere with or disrupt the operation of the Services, use automated systems to access the Services without permission, or misrepresent your identity or affiliation.
8. Data and Privacy
Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection, use, and sharing of data as described in that policy, including the sharing of aggregated and de-identified data with business partners.
9. White-Label and Partner Products
Eclipse RX, LLC may offer versions of the BURŪV product or technology through partnerships with third-party brands ("Partner Products"). If you use a Partner Product, these Terms still apply to the underlying technology and data collection. The partner's own terms and privacy policy will also apply to their branded experience. Data collected through Partner Products is subject to the same de-identification and aggregation standards described in these Terms and our Privacy Policy.
10. Limited Product Warranty
Eclipse RX, LLC warrants to the original purchaser that the BURŪV smart band will be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of original delivery ("Warranty Period"). During the Warranty Period, if a manufacturing defect is confirmed, we will, at our sole discretion, repair or replace the defective product at no charge, including shipping costs.
This warranty covers defects in manufacturing, sensor malfunction not caused by external damage, battery failure under normal use, and Bluetooth connectivity failures attributable to the hardware. This warranty does not cover damage resulting from misuse, accident, unauthorized modification, or repair by anyone other than Eclipse RX, LLC, normal wear and tear including cosmetic damage such as scratches and scuffs, water damage beyond the product's rated water resistance, damage caused by use with non-compatible devices or accessories, or loss or theft of the product.
To make a warranty claim, contact us at Support@buruv.com with your order number and a description of the issue. We may request photos or ask you to return the product for inspection. Warranty replacements do not extend or restart the original Warranty Period.
11. Disclaimer of Warranties
EXCEPT FOR THE EXPRESS LIMITED WARRANTY IN SECTION 10, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BURŪV IS NOT A MEDICAL DEVICE. UV EXPOSURE DATA IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT REPLACE PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. SENSOR ACCURACY MAY VARY BASED ON ENVIRONMENTAL CONDITIONS, DEVICE PLACEMENT, AND OTHER FACTORS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECLIPSE RX, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Eclipse RX, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Services or violation of these Terms.
14. Communications and Marketing Consent
By creating an account or making a purchase, you consent to receive transactional communications from us, including order confirmations, shipping updates, and service-related notices. These are not marketing messages and cannot be opted out of while you maintain an active account.
With your separate opt-in consent, we may send you marketing communications via email or SMS about product updates, promotions, and sun protection tips. You may opt out of marketing messages at any time by following the unsubscribe instructions in any marketing email, replying STOP to any marketing text message, or contacting us at Support@buruv.com. Opting out of marketing communications does not affect transactional messages. Message and data rates may apply for SMS communications. Message frequency varies.
15. Governing Law
These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Johnson County, Kansas.
16. Force Majeure
Eclipse RX, LLC shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, supply chain disruptions, carrier delays, labor disputes, or interruptions to utilities or telecommunications. In the event of a force majeure occurrence, our obligations will be suspended for the duration of the event, and we will use commercially reasonable efforts to resume performance as soon as practicable.
17. Changes to These Terms
We may modify these Terms at any time by posting updated Terms on our website or through the App. Material changes will be communicated through the App or by email. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
18. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms. Upon termination, your right to use the App and Services ceases, but provisions that by their nature should survive termination (including data ownership and license, warranty terms, disclaimers, limitations of liability, and indemnification) will remain in effect.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
