BURŪV Privacy Policy

EclipseRX, LLC, doing business as BURŪV ("we," "us," or "our"), operates the BURŪV mobile application (the "App") and related websites. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our products and services, including the BURŪV smart band.

1. Information We Collect

1.1 Information You Provide

Account registration details (name, email address, shipping address). Payment information processed through our third-party payment processor (Shopify Payments). Skin profile data you enter in the App (skin type, SPF product selection). Communications you send to us (support requests, feedback).

1.2 Promotional, Sweepstakes, and Marketing Sign-Ups

When you enter a giveaway or sweepstakes, subscribe to our newsletter, or otherwise submit your contact information through a promotional landing page or advertisement, we collect the information you provide - which may include your name, email address, and mobile phone number. This information is used to administer the promotion, notify winners, and, where you have consented, send you marketing communications. Our sweepstakes and giveaway promotions are open only to legal residents of the United States, unless the applicable official rules state otherwise. Participation in any sweepstakes or giveaway is additionally governed by that promotion's official rules, published separately (for example, our Sunblock Party Sweepstakes Rules), which take precedence over this Policy on matters of eligibility, odds, and prize fulfillment.

Where you have provided your mobile phone number and consented to receive text messages - for example, when entering a giveaway or sweepstakes - we may use it to send winner notifications and, if you've opted in, marketing text messages. Message and data rates may apply, and you may opt out at any time by replying STOP or by contacting us at support@shop.buruv.com.

1.3 Information Collected Automatically

We and our advertising partners (including Meta and Google) use pixels, cookies, and similar tracking technologies on our websites to measure the performance of our advertising, understand how visitors interact with our site, and deliver relevant ads to you on other platforms. These technologies may collect information such as pages visited, actions taken (for example, submitting a form or completing a purchase), and device or browser identifiers.

For certain advertising features - including Google's Enhanced Conversions and Meta's Advanced Matching and Conversions API - we share a hashed (cryptographically obscured) version of information you provide at checkout, such as your email address and phone number, with these partners so they can more accurately match your purchase to the advertising that led to it. Google and Meta act as data processors for this information under their respective data processing terms, and are contractually restricted in how they may use it. You can control cookie preferences through your browser settings, and where required by law, we provide an opt-out mechanism described in Section 6 below.

1.4 Information from Third Parties

If you choose to connect your BURŪV to Apple HealthKit, we may receive limited information from the data categories you authorize. We do not sell or share HealthKit data with third parties for advertising or marketing purposes, in accordance with Apple's HealthKit requirements.

2. How We Use Your Information

We use the information we collect to operate and improve the product and App experience, deliver personalized UV exposure insights and sun safety notifications, process orders and manage your account, communicate product updates and service-related messages, generate aggregated and de-identified insights about sun protection behavior for product improvement and research, and comply with legal obligations.

If you opt in to receive text messages from BURŪV, we will use your mobile number only to send the messages you have chosen to receive. These may include order and shipping updates, band and account alerts, sun exposure alerts, and, if you separately consent, marketing messages. 

Consent to receive text messages is not a condition of any purchase. Message frequency varies. You may receive up to 20 messages per month. Message and data rates may apply. You can opt out at any time by replying STOP. Reply HELP for help or contact support@shop.buruv.com.

No mobile information will be shared with or sold to third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Where this Privacy Policy describes sharing of aggregated or de-identified data with partners, that sharing never includes your mobile number, your text messaging, opt-in data, or your consent to receive text messages.

3. How We Share Your Information

3.1 We Do Not Sell Personal Information

We do not sell your personal information as defined under applicable privacy laws, including the California Consumer Privacy Act (CCPA).

3.2 Advertising and Analytics Partners

We share limited information with advertising and analytics partners, including Meta and Google, to measure ad performance and deliver relevant advertising, as described in Section 1 above. Depending on your state of residence, this activity may be considered a "share" of personal information for cross-context behavioral advertising under laws such as the California Consumer Privacy Act (CCPA/CPRA) and similar laws in other states, even though we do not sell your information for money. Where required by law, you may opt out of this sharing using the mechanism described in Section 6.

3.3 Service Providers

We share information with service providers who assist in order fulfillment, payment processing, email communications, cloud hosting, and analytics. These providers are contractually obligated to use your data only to perform services on our behalf.

3.4 Aggregated and De-Identified Data

We may share aggregated or de-identified data with business partners, including sun protection and skincare companies, for purposes such as product development, suncare research, behavioral insights, and personalized recommendations. This data is stripped of personal identifiers and processed so that re-identification of any individual is not reasonably possible. Examples of aggregated data include regional UV exposure trends, sunscreen reapplication rates by skin type, notification response patterns, and general behavioral insights related to sun protection habits. This data may be shared under commercial data licensing arrangements.

3.5 Legal Requirements

We may disclose information when required by law, legal process, or to protect the rights and safety of our company and users.

4. Data Security

We implement commercially reasonable security measures to protect your information, including encryption of data in transit and at rest. Bluetooth communication between the band and your Apple Watch uses standard Apple Watch accessory protocols. We regularly evaluate and improve our security practices. No method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security. Our data infrastructure is designed for consumer wellness applications and employs industry-standard protections appropriate to the nature of the data we collect.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide services. UV exposure data is stored on your device and synced to your account. Aggregated and de-identified data may be retained indefinitely for research and business purposes, as it cannot be linked back to any individual. You may request deletion of your account and associated personal data at any time by contacting us.

Promotional and sweepstakes entry data is retained for as long as needed to administer the applicable promotion and comply with recordkeeping requirements under state sweepstakes laws, after which it is deleted or anonymized unless you have separately opted in to ongoing marketing communications.

6. Your Rights and Choices

Depending on your jurisdiction, you may have the right to access, correct, or delete your personal information, opt out of marketing communications, request a portable copy of your data, withdraw consent for data processing, and, for California residents, request information about data shared with third parties. California residents, and residents of other states with similar rights, may opt out of the "sharing" of personal information for cross-context behavioral advertising described in Section 3.2 by emailing us at support@shop.buruv.com. You may opt out of text messages at any time by replying STOP to any message we send, and you may opt out of email marketing using the unsubscribe link in any marketing email.

7. Apple HealthKit

If you choose to connect your BURŪV to Apple HealthKit, we access only the data categories you authorize. HealthKit data is not used for advertising or marketing, is not shared with third parties except as required to provide core App functionality, and is not included in any aggregated or de-identified datasets shared with business partners.

8. Children's Privacy

Our products and services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will delete it promptly.

Our sweepstakes and giveaway promotions are open only to entrants who meet the minimum age stated in the applicable official rules, and we do not knowingly collect entries from minors.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website or through the App and updating the effective date. Your continued use of our products and services after changes are posted constitutes acceptance of the updated policy.
